Overview

Segen Consulting (hereafter Segen and/or we) is committed to providing high quality recruitment services and solutions to jobseekers, clients and referees (hereafter you and/or your) across Australia and in Singapore.

This policy outlines Segen’s position on privacy.  Segen respects the privacy of every individual and is committed to protecting the personal data that it collects in accordance with the laws of the countries in which Segen operates. 

We request that you please take the time to read and understand this policy, which outlines how Segen will collect your personal data and how we maintain, use, store and disclose your personal data in connection with your application via our services, including but not limited to the Segen website page, LinkedIn and/or contact made with a member of the Segen team. 

This policy will be updated when our information handling practices change. We will publish a new updated version on our website and through our email lists so you become aware of any changes.

What is personal data?

In this policy, “personal data” means any information relating to an identified or identifiable natural person.  An identifiable person is one who can be identified, directly or indirectly, and in particular by reference to an identification number or to one or more factors specific to a person’s physical, physiological, mental, economic, cultural or social identity or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion.

What is sensitive personal data?

Personal data includes “sensitive personal data”, which includes information or an opinion about an individual’s racial or ethnic origin, political opinion, membership of a political association or trade union, religious or philosophical beliefs, sexual life, sexual orientation, health, political or union related views or activities and the commission or alleged commission of offences and related proceedings including administrative or criminal sanctions.

Do you need to provide your personal data?

You are not required to supply any of the personal data that we may request; however, if the personal data we request is not provided, we may not be able to provide services to you in the most effective or efficient manner or at all.  We may also be limited in our ability to locate suitable work for you or in our ability to place you in work.

How does Segen collect personal data?

To enable us to fulfil our responsibilities as a provider of recruitment services to you, Segen collects personal data about you, to enable Segen to effectively conduct its business.  This personal data must be sufficiently detailed for Segen to conduct its business.

We will only collect personal data to the extent that it is required for the specific purposes set out in this policy or notified to you at the time of collection.  Segen could hold the following types of personal data about you:

·       information that you give to us;

·       information that we collect about you; and/or

·       information that we receive from other sources.

We only collect personal data for our business purposes as set out below:

·       when you fill out our registration forms or provide any other information or documentation (e.g. resume, cover letter, drive licence) though our consultants, via our online website page www.segen.com.au, e-mail, telephone, from other website, media and publications or other publicly available sources and third parties;

·       when we receive any reference about you, information recorded when you attend our office for an interview or participate in a telephone or skype interview with us;

·       when we receive results of inquiries that we might make of your former employers, work colleagues, professional associations or registration body;

·       when we receive the results of any competency or medical test or background checks including credit and criminal record checks, with your previous consent;

·       any complaint or other information from or about you in the workplace or workplace accident in which you are involved;

·       any information about any insurance investigation, litigation, registration or professional disciplinary matter, criminal matter, inquest or inquiry in which you were involved;

·       when we collect information about you from public domain sources;

·       information on a role you provide us with, including but not limited to business structure, contact details and information that is necessary to help us managing the presentation and delivery of our recruitment services; and

·       when you provide us with any additional information about you.

What happens when you visit Segen’s website?

When you visit our website, information about your computer or web device is automatically recorded by our website.  This includes your IP address and associated domain name (if applicable), the date and time of your visit to our website, the pages that you accessed or downloaded, the address of the last site that you visited, your operating system and the type of browser that you are using. 

 How does Segen use and disclose your personal data?

Your data will be processed fairly, lawfully and in an appropriate way.

We will only use your personal data for the purpose for which it was collected or for related purposes permitted by applicable laws.  These uses include (but are not limited to), those set out below:

·       Work placement operations;

·       Career guidance or management;

·       Recruitment functions across jobseekers, clients and referees;

·       Any enquires from you about job opportunities or new development that may be of your interest;

·       Communication about marketing, articles, news, events or courses related to our industry or your interest;

·       Any tests such as psychometric evaluations, medical or skills tests;

·       Administrative tasks by third party providers who provide services to us, such as IT consultants and associates located outside of Australia;

·       Any workplace rehabilitation;

·       Our management and resolution of any complaint, inquiry or investigation in which you are involved;

·       Any insurance claim or proposal that requires disclosure of your personal or sensitive information;

·       Undertaking criminal reference checks and other background checks, including credit checks for positions overseas involving significant financial risk and otherwise as permitted by law;

·       For client and business relationship management; and

·       Statistical purposes and statutory compliance requirements.

Segen uses personal data to provide, manage and administer the recruitment services that it provides.  You agree that we have the right to share your personal information in the normal course of our business operations to be able to provide such services.

Your personal data may be disclosed in a number of circumstances, which include (but are not limited to) the following:  

·       Internal employees and related entities;

·       To our clients and trusted third parties who may be based outside of Australia;

·       Referees contacts for job suitability and screening purposes;

·       Background checking and screening agents;

·       External providers of online training and induction, for example mandatory on-line OH&S Induction, and background checking agencies, for example criminal record and credit checking;

·       Third party contractors/service providers for the purposes of assisting us in Australia or outside of Australia to provide you with our services, and/or to improve the services we offer you including:

o   providing us with specialised and efficient database management, administrative services, development and storage; and

o   assisting with the provision of marketing communications to you.

·       Insurance brokers, loss assessors and underwriters;

·       Superannuation fund managers;

·       Legal and other professional advisors;

·       A professional association or registration body that has a proper interest in the disclosure of your personal and sensitive information; or

·       Any person with a lawful entitlement to obtain the information.

In circumstances where we disclose your information to third parties, Segen undertakes to do everything within its control to ensure that suppliers comply with the applicable legislation relating to privacy in their own country, including policies and legislation.  A copy of this policy is available for all applicable third parties.

What happens if there is a change behind the scenes at Segen?

 We reserve the right to transfer your information to a third party in the event of a sale, merger, liquidation, receivership or transfer of all or substantially all of the assets of our company provided that the third party agrees to adhere to the terms of this policy and provided that the third party only uses your personal for the purposes that you provided it to us. You will be notified in the event of any such transfer and you will be afforded an opportunity to opt-out.

How long will Segen retain your personal data?

We will keep your personal data for as long as is necessary in accordance with our records management policies for the purpose or purposes for which it was collected.  We will take all reasonable steps to delete from our systems all data which is no longer required. 

Segen will delete any personal data that we hold about you when it is no longer required and we are legally able to do so.   Note that we may retain some limited information about you, even when we know that you do not currently require our services, so that we can maintain a continuous relationship with you.

Segen’s commitment to the safety of your personal data? 

All information you provide to us is stored on our secure servers.  Where we have given you (or where you have chosen) a password which enables you to access certain parts of our website, it is your responsibility to keep this password confidential.

We ask you not to share your password with anyone.  Your personal data will be processed in a manner that protects the confidentiality, integrity and availability of the personal data that we hold.

Your ability to access or correct your personal data 

Subject to some exceptions set out in privacy law, you can gain access to your personal information that we hold[JV2] . 

Contact us if you find your personal information that we hold about you is inaccurate, out of date, incomplete or irrelevant and we will take the steps as are reasonable in the circumstances to update our clients and third party suppliers unless it is impracticable or unlawful for us to do so.

While you can lodge a complaint about our processing of your personal information with the relevant data protection authority in the jurisdiction in which you are located, we ask that complaints are first made to us in writing so that we can look into your concerns.
